Legal Protections for MMJ Cardholders in Arizona
1. Protection from Arrest or Prosecution
As a qualified MMJ patient, you are legally protected under the Arizona Medical Marijuana Act (AMMA – A.R.S. §â€¯36‑2811) and cannot be penalized for possessing, purchasing, or using cannabis for medical purposes.
2. Drug Testing & Employment Rights
Employers cannot fire or discipline an employee solely for testing positive for THC if they are a registered medical marijuana cardholder. There is currently no Arizona law defining specific levels of THC metabolites as impairment, so a positive test alone does not prove you’re under the influence.
Employers must have a good-faith belief of on-the-job impairment to take action—based on observable signs like odor, slurred speech, or poor coordination.
3. Workplace Exceptions
If your job is considered safety-sensitive (e.g., commercial driving, operating heavy machinery), or if you’re employed by a federally regulated company, your employer may lawfully prohibit cannabis use, regardless of cardholder status.

4. Family & Custody Protections
Arizona law protects MMJ patients from discrimination in family court matters. Under A.R.S. §36-2813, a parent’s status as a qualified medical marijuana cardholder cannot be used as the sole reason to deny custody or visitation rights. Courts focus on the best interests of the child, and legal, responsible MMJ use is not considered abuse or neglect. As long as your use does not impair your ability to parent safely, your MMJ status should not negatively affect custody or visitation rulings.

5. Firearm Protections
Arizona law does not prohibit MMJ cardholders from owning or possessing firearms. Under state law, being a registered medical marijuana patient does not disqualify you from firearm ownership. However, under federal law (Gun Control Act of 1968), marijuana is still classified as a Schedule I substance. This means federally licensed firearms dealers (FFLs) cannot legally sell a firearm to anyone who admits to marijuana use—regardless of state law.
That said, having a valid MMJ card offers more legal clarity and potential protection under Arizona law than recreational use. Arizona’s Medical Marijuana Act (AMMA) establishes a patient’s legal right to use cannabis medicinally, whereas recreational users have no such statutory protections regarding firearms.

6. Housing Protections
In Arizona, landlords generally cannot evict or refuse to rent to a tenant solely because they are a registered MMJ patient. However, landlords can prohibit smoking on the premises if outlined in the lease. Patients may still be protected when using cannabis in other forms (edibles, tinctures, etc.), especially if use occurs privately and in compliance with the law.
Federal housing programs (like Section 8) are not required to accommodate MMJ use due to federal law. If you live in federally subsidized housing, MMJ use could still be restricted.
